1. Acceptance of Terms

By creating an account or using Smoothly.me (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms constitute a binding legal agreement between you and Smoothly.me, LLC ("Smoothly," "we," "us," or "our").

You must be at least 18 years of age to use the Platform. By accepting, you represent that you meet this requirement.

2. Description of Service

Smoothly is an AI-powered dating communication coaching platform. We provide AI-generated response suggestions to help users craft messages for use on third-party dating applications. Smoothly does not operate a dating service, does not facilitate matches, and is not affiliated with any third-party dating application.

The Platform includes:

AI response generation using official Smoothly personalities and creator-trained models
A Creator Marketplace where verified experts publish AI coaching models
A SMTHLY token economy for purchasing AI responses
Smoothly Plus subscription for enhanced access
A referral program
Creator verification via zero-knowledge proof technology

3. Accounts and Registration

You must provide accurate information when creating your account, including a valid email address. You are responsible for maintaining the security of your account credentials. Smoothly is not liable for any loss resulting from unauthorized use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or abuse the Platform.

4. SMTHLY Tokens

SMTHLY tokens ("Tokens") are digital credits used solely within the Smoothly Platform to purchase AI-generated responses. Tokens are not currency, not an investment, and have no monetary value outside the Platform.

Purchases: Token bundles are purchased via Stripe. All sales are final. Tokens do not expire.
No Refunds: Purchased Tokens are non-refundable except as required by applicable law or at Smoothly's sole discretion.
Token Economy: Token prices and bundle configurations may change with notice.

Blockchain Disclosure: As part of our integration with the XION blockchain, your Smoothly account may be associated with a XION blockchain wallet address. When this feature is active, your SMTHLY token balance and creator verification badge may be recorded on the XION public blockchain. This means your wallet address and token holdings will be publicly visible on-chain. No personal identifying information (name, email, or dating app data) is published to the blockchain. You will be notified before any on-chain activity is initiated on your behalf.

5. Smoothly Plus Subscription

Smoothly Plus is a recurring subscription available monthly ($12.99/month) or annually ($99.99/year). Subscriptions renew automatically at the end of each billing period. You may cancel at any time through your account settings. Cancellation takes effect at the end of the current billing period. No prorated refunds are provided for unused subscription time.

6. Creator Program

Users who pass creator verification may publish AI coaching models to the Marketplace. By participating as a Creator, you agree to the following:

Verification: Creator status requires verification of your real dating application results via Reclaim Protocol zero-knowledge proof technology. This verifies your match count, conversation count, and conversation rate without exposing your dating app credentials or message content to Smoothly.
Revenue Share: Creators earn a percentage of tokens spent on their models. The revenue share percentage is determined by your creator tier (Verified: 35%, Battle Tested: 37%, Elitely Smooth: 40%).
Payouts: Earnings are paid via Stripe Connect. You are responsible for providing accurate payout information and complying with applicable tax obligations. Smoothly will issue 1099s as required by law.
Content Standards: All model names, descriptions, and training data are subject to moderation. Content that is discriminatory, harassing, sexually explicit, or otherwise harmful is prohibited and will result in immediate removal and potential account termination.
Dormancy: Models that show no activity for 75 days will receive a warning. Models inactive for 90 days may be deactivated.
Fine-Tuning: Smoothly may fine-tune AI models using aggregated, anonymized patterns from creator training data to improve response quality. Individual user messages are not used for model training without explicit consent.
Tier Promotion: Creator tier upgrades are determined automatically based on platform engagement metrics including response ratings, copy rates, and nudge rates.

7. Referral Program

Smoothly operates a referral program. Smoothly operates a referral program. Referral rewards are subject to change at any time.

8. Acceptable Use

You agree not to:

Use the Platform to generate content intended to deceive, harass, or harm others
Attempt to reverse-engineer, scrape, or extract data from the Platform
Share, sell, or transfer your account to another person
Circumvent any Platform security measures
Use AI-generated responses in ways that violate third-party dating applications' terms of service
Submit false or fraudulent creator verification proofs
Engage in any activity that disrupts the Platform or harms other users

9. AI-Generated Content Disclaimer

All responses generated by Smoothly are AI-generated suggestions. Smoothly does not guarantee the accuracy, appropriateness, or effectiveness of any AI-generated response. You are solely responsible for the messages you choose to send to others. Smoothly is a coaching tool — the decision to use any suggested response is entirely yours.

10. Third-Party Services

Smoothly integrates with the following third-party services. Your use of these services is subject to their respective terms and privacy policies:

Firebase / Google — Authentication, database, and cloud infrastructure
OpenAI — AI response generation (messages you submit are processed by OpenAI)
Stripe — Payment processing and creator payouts
SendGrid — Transactional email delivery
Reclaim Protocol — Zero-knowledge proof verification of dating app statistics
XION Foundation — Blockchain wallet infrastructure and on-chain token management

11. Intellectual Property

All Platform content, branding, and code is owned by Smoothly.me, LLC. Creator-submitted training data remains the intellectual property of the creator. By submitting training data, you grant Smoothly a non-exclusive license to use that data to improve and operate the Platform.

AI-generated responses produced through the Platform are provided to you for personal use. You may use them freely in your personal communications.

12. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. SMOOTHLY DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL PRODUCE ANY PARTICULAR OUTCOME IN YOUR PERSONAL RELATIONSHIPS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMOOTHLY'S LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO SMOOTHLY IN THE THREE MONTHS PRECEDING THE CLAIM.

13. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved by binding arbitration in Miami-Dade County, Florida.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice within the Platform. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

1. Overview

Smoothly.me, LLC ("Smoothly," "we," "us") is committed to protecting your privacy. This Privacy Policy explains what information we collect, how we use it, and your rights regarding your data. By using the Platform, you agree to the practices described here.

2. Information We Collect

Account Information: When you register, we collect your email address and display name. If you sign in with Google, we receive your Google account email and display name.

Usage Data: We collect information about how you use the Platform, including which AI models you use, your communication style preferences, token balance, purchase history, subscription status, and referral activity.

Message Content: When you submit a message for AI coaching, that message text is processed to generate a response and stored in your response history. This includes the original message you submitted, the AI's reasoning, and the suggested response.

Profile Image: If you upload a profile photo, it is stored in Google Cloud Storage.

Creator Data: For verified creators, we store your dating application statistics (match count, conversation count, conversation rate), your AI model configuration, performance metrics, earnings records, and Stripe Connect account identifier.

Device and Session Data: Firebase automatically collects device type, browser type, IP address, and session information for security and functionality purposes.

What We Do Not Collect: We never receive your dating app login credentials. The Reclaim Protocol verification process uses zero-knowledge proof technology and a Trusted Execution Environment (TEE) — your Tinder username and password are never transmitted to Smoothly's servers. We receive only a cryptographic proof that you met the verification thresholds, plus the aggregate statistics (match count, conversation count, conversation rate). Your actual dating app messages and conversations are never visible to us.

3. How We Use Your Information

Operate the Platform — authenticate your account, process tokens, generate AI responses, manage subscriptions
Process Payments — manage token purchases, subscriptions, and creator payouts via Stripe
Creator Verification — validate dating app statistics via Reclaim Protocol to determine creator eligibility
Improve AI Quality — analyze aggregated, anonymized usage patterns to improve response quality
Communications — send transactional emails (verification codes, receipts, referral notifications, creator alerts) via SendGrid
Fraud Prevention — detect and prevent abuse, fraudulent verification attempts, and Terms violations
Legal Compliance — meet obligations under applicable law including tax reporting (creator 1099s)

We do not use your conversation data for third-party advertising. We do not sell your personal information.

4. Third-Party Services and Data Sharing

We share data with these service providers to operate the Platform:

Google / Firebase — Authentication (Firebase Auth), database (Firestore), cloud functions, hosting, and file storage (Cloud Storage). Subject to Google's Privacy Policy.
OpenAI — The message text you submit for coaching is sent to OpenAI's API to generate a response. OpenAI processes this under their API data usage policies. OpenAI does not use API inputs to train their models by default.
Stripe — All payment card data is handled directly by Stripe. We never receive or store your card number. Stripe processes payments and manages creator payout accounts under their Privacy Policy.
SendGrid (Twilio) — Transactional emails are delivered via SendGrid. Your email address is shared with SendGrid for delivery purposes only.
Reclaim Protocol — When you initiate creator verification, Reclaim Protocol facilitates a zero-knowledge proof of your Tinder statistics. Your dating app credentials are handled exclusively within Reclaim's Trusted Execution Environment and are never transmitted to Smoothly.
XION Foundation — When blockchain features are active, your XION wallet address and SMTHLY token balance are recorded on the XION public blockchain. This data is publicly visible by design. See the Blockchain section below.

We do not share your data with advertisers, data brokers, or any third party not listed above, except as required by law.

5. Blockchain and On-Chain Data

Important: Smoothly integrates with the XION blockchain. When this integration is active, a blockchain wallet address is created and associated with your account. The following information may be recorded on the XION public blockchain, where it is permanently and publicly visible:

Your XION wallet address (a pseudonymous identifier, e.g. xion1…)
Your SMTHLY token balance and transaction history
Creator verification badge (proof that you passed verification — no personal details)

Your name, email address, dating app data, and message history are never published to the blockchain. Blockchain records are permanent and cannot be deleted once written. By accepting these terms, you acknowledge and consent to this on-chain data being publicly visible.

6. Response History and Message Content

Messages you submit for AI coaching are stored in your response history in Firestore. This allows us to provide context for improving your experience and for creator earnings attribution. You may request deletion of your response history by contacting us at [email protected].

Your response history is not used to train AI models without aggregation and anonymization. Individual message content is not shared with third parties except OpenAI (for response generation) and as required by law.

7. Data Retention

We retain your account data for as long as your account is active. If you delete your account, we will delete your personal data within 30 days, except where retention is required by law (e.g., financial records for tax purposes, which are retained for 7 years).

On-chain data (blockchain records) cannot be deleted due to the immutable nature of public blockchains.

8. Cookies and Local Storage

We use the following browser storage:

Firebase Auth Token — A session token stored in your browser to keep you logged in. Required for Platform functionality.
UI Preferences — Small preference flags (e.g., whether you have dismissed certain banners) stored in localStorage. These contain no personal data and are never transmitted to our servers.

We do not use advertising cookies or cross-site tracking cookies.

9. Children's Privacy

Smoothly is not directed to individuals under 18 years of age. We do not knowingly collect personal information from minors. If we become aware that a minor has provided us with personal information, we will delete it promptly.

10. Your Rights

Depending on your location, you may have the following rights regarding your personal data:

Access — Request a copy of the data we hold about you
Correction — Request correction of inaccurate data
Deletion — Request deletion of your account and personal data
Portability — Request your data in a machine-readable format
Objection — Object to certain processing activities

11. Security

We implement industry-standard security measures including encrypted data transmission (TLS), Firebase Authentication for access control, server-side token verification for all API requests, and Stripe for PCI-compliant payment handling. No system is completely secure, and we cannot guarantee absolute security of your data.

12. Changes to This Policy

We may update this Privacy Policy periodically. We will notify you of material changes via email or a Platform notice at least 14 days before changes take effect. Continued use after the effective date constitutes acceptance.
