1Acceptance of Terms

By creating an account or using Smoothly.me (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform. These Terms constitute a binding legal agreement between you and Smoothly.me, LLC ("Smoothly," "we," "us," or "our").

You must be at least 18 years of age to use the Platform. By accepting, you represent that you meet this requirement.

2Description of Service

Smoothly is an AI-powered dating communication coaching platform. We provide AI-generated response suggestions to help users craft messages for use on third-party dating applications. Smoothly does not operate a dating service, does not facilitate matches, and is not affiliated with any third-party dating application including Tinder, Hinge, or Bumble.

The Platform includes:

• AI response generation using official Smoothly personalities and creator-trained models
• A Creator Marketplace where verified experts publish AI coaching models
• A SMTHLY token economy for purchasing AI responses
• Smoothly Plus subscription for enhanced access
• A referral program for both consumer and creator users
• Creator verification via Reclaim Protocol zero-knowledge proof technology
• XION blockchain integration for on-chain token management (see Section 11)

3Accounts and Registration

You must provide accurate information when creating your account, including a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Smoothly uses Firebase Authentication (Google) to manage account security. You agree to notify us immediately at [email protected] if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, submit false verification proofs, or abuse the Platform in any way.

4SMTHLY Tokens

SMTHLY tokens ("Tokens") are digital credits used solely within the Smoothly Platform to purchase AI-generated responses. Tokens are not currency, not an investment, and have no monetary value outside the Platform.

• Purchases: Additional Tokens are purchased via Stripe in the following bundles: Ice Breaker ($5), Double Take ($10), Silver Tongue ($25), Heartthrob ($50), Irresistible ($100), and Legend ($200). All sales are final.
• No Expiry: Purchased Tokens do not expire while your account remains active.
• No Refunds: Purchased Tokens are non-refundable except as required by applicable law or at Smoothly's sole discretion.
• Pricing: Token bundle pricing and configurations may change. We will provide notice of material pricing changes.
• On-Chain Tokens: When the XION blockchain integration is active, your Token balance may also be reflected on the XION public blockchain. See Section 11.

5Smoothly Plus Subscription

Smoothly Plus is a recurring subscription available at $12.99/month or $99.99/year. Subscriptions are processed by Stripe and renew automatically at the end of each billing period unless cancelled.

You may cancel at any time through your account settings or by contacting [email protected]. Cancellation takes effect at the end of the current billing period. No prorated refunds are provided for unused subscription time. Smoothly reserves the right to modify Smoothly Plus benefits or pricing with advance notice.

6Creator Program

Users who pass creator verification may publish AI coaching models to the Marketplace. By participating as a Creator, you agree to the following:

• Verification Requirements: Creator status requires passing a zero-knowledge proof verification of your Tinder dating statistics via Reclaim Protocol. Minimum thresholds are 40 or more matches, 18 or more conversations, and a conversation rate of 35% or higher. Thresholds may be adjusted over time.
• Verification Technology: Reclaim Protocol uses zero-knowledge proof technology and a Trusted Execution Environment (TEE). Your Tinder login credentials are never transmitted to Smoothly's servers. We receive only a cryptographic proof confirming you met the thresholds, plus your aggregate statistics (match count, conversation count, conversation rate).
• Creator Tiers: Creators are assigned a tier based on platform performance: Verified (Tier 1), Battle Tested (Tier 2), and Elitely Smooth (Tier 3). Tier promotions are determined automatically based on engagement metrics including thumbs-up ratings, response copy rates, and nudge rates.
• Revenue Share: Creators earn a percentage of Tokens spent on their models: Verified 35%, Battle Tested 37%, Elitely Smooth 40%. Earnings are converted to USD for payout.
• Payouts: Earnings are paid via Stripe Connect. You must provide accurate payout information and comply with applicable tax obligations. Smoothly will issue 1099 tax forms as required by law.
• Referral Earnings Share: If you were referred by another creator, that creator receives a 5% share of your earnings for 90 days following your model publication.
• Content Standards: All model names, descriptions, training data, and communication style inputs are subject to content moderation. Prohibited content includes material that is discriminatory, harassing, sexually explicit, or otherwise harmful. Violations result in immediate removal and potential account termination.
• Model Fine-Tuning: Smoothly may use aggregated, anonymized patterns from creator training data to improve AI model quality. Individual submissions are not shared with third parties.
• Dormancy: Models with no usage activity for 75 days receive a warning notification. Models inactive for 90 days may be deactivated. Contact [email protected] to reactivate.
• Creator Badge NFT: When XION blockchain integration is active, verified creators receive an on-chain badge NFT representing their tier. See Section 11.

7Referral Program

• Consumer Referral: When a user you refer makes their first token purchase, you receive a referral reward.
• Creator Referral: When a creator you refer publishes their AI model, you receive a referral reward.

Referral rewards are subject to change or discontinuation at any time. Fraudulent referral activity — including self-referrals or creating fake accounts — will result in reward forfeiture and account termination.

8Acceptable Use

You agree not to:

• Use the Platform to generate content intended to deceive, manipulate, harass, or harm others
• Use AI-generated responses in ways that violate third-party dating application terms of service
• Reverse-engineer, scrape, or extract proprietary data or models from the Platform
• Share, sell, or transfer your account or token balance to another person
• Circumvent security measures or exploit the token economy
• Submit false, fabricated, or manipulated creator verification proofs
• Engage in activity that disrupts, degrades, or interferes with Platform infrastructure
• Impersonate Smoothly staff or other users
• Use the Platform if you are under 18 years of age

9AI-Generated Content Disclaimer

All responses generated by Smoothly are AI-generated suggestions. Smoothly does not guarantee the accuracy, appropriateness, or effectiveness of any AI-generated response. AI models may occasionally produce responses that are inappropriate, inaccurate, or unsuitable for your specific situation.

You are solely responsible for reviewing AI-generated content before using it in your personal communications. The decision to use, modify, or discard any suggested response is entirely yours. Smoothly is not liable for any outcome resulting from your use of AI-generated suggestions.

10Third-Party Services

Smoothly integrates with the following third-party services. Your use of these services is subject to their respective terms and privacy policies:

Smoothly is not responsible for the practices, policies, or security of any third-party service.

11Blockchain Integration

When XION blockchain integration is active:

• A XION blockchain wallet address is automatically created and associated with your account. This address is a pseudonymous identifier (e.g., xion1…) — it does not contain your name or email.
• Your SMTHLY token balance and token transaction history are recorded on the XION public blockchain and are publicly visible.
• Verified creators receive an on-chain badge NFT representing their creator tier. This badge is publicly visible on the blockchain.
• Blockchain records are permanent and cannot be deleted or modified once written, due to the immutable nature of public blockchains.

Your name, email address, dating application data, message history, and payment information are never published to the blockchain. By accepting these Terms, you acknowledge and consent to the on-chain recording of wallet address, token balance, and creator badge data as described above.

XION provides gasless transaction capability — you will never be required to hold or spend any cryptocurrency to use Smoothly.

12Intellectual Property

All Platform content, branding, code, and AI model architecture is owned by Smoothly.me, LLC. Creator-submitted training data and model configurations remain the intellectual property of the creator. By submitting training data, you grant Smoothly a non-exclusive, royalty-free license to use that data to operate and improve the Platform.

AI-generated responses produced through the Platform are provided to you for personal use. You may freely use them in your personal communications. Smoothly claims no ownership over messages you choose to send.

13Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. SMOOTHLY DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, APPROPRIATE, OR EFFECTIVE FOR YOUR PURPOSES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SMOOTHLY'S TOTAL LIABILITY TO YOU FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO SMOOTHLY IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

SMOOTHLY IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL.

14Termination

You may delete your account at any time by contacting [email protected]. Upon deletion, your personal data will be removed within 30 days, subject to legal retention requirements. Unused purchased Tokens are forfeited upon voluntary account deletion. On-chain blockchain data cannot be removed due to the immutable nature of public blockchains.

Smoothly may suspend or terminate your account immediately and without notice for any material violation of these Terms, fraudulent activity, or conduct harmful to the Platform or other users. Termination for cause does not entitle you to a refund of purchased Tokens.

15Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising from or related to these Terms or your use of Smoothly shall be resolved by binding arbitration in Miami-Dade County, Florida, under the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property matters.

BY USING THE PLATFORM, YOU WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION LAWSUIT.

16Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a prominent notice within the Platform at least 14 days before changes take effect. Continued use after the effective date constitutes acceptance. If you do not agree to revised Terms, you must
